This chapter analyzes five cases in which the Turkish Constitutional Court banned political parties, advocating for equal citizenship rights for the Kurdish people, based on their alleged violation of the law on political parties, which prohibits claims of the existence of minorities. The chapter aims to explore the conceptualization of minority rights within the juridico-political realm of Turkey, with a specific focus on Kurdish linguistic rights. The judgments of the Constitutional Court constitute a significant empirical axis as they provide insights not only into the strategic conceptualization of the minority by the state apparatus to absorb differences deemed threats to the unity of the Turkish nation but also into the tactical counter-conceptualization of it by the defenses. Thus, informed by Foucauldian insights, the conflicting legal framings and conceptualization of the minority and their potential to prevent or trigger social change can be explored.
